你听说过“996工作制”吗?最近,“996.ICU”引起了大家的热议。有人在代码托管平台GitHub上面发起了一个名为“996.ICU”的项目,呼吁大家抵制互联网公司超时工作。随后迅速传播开来,获得了许多程序员的支持,目前在GitHub上的加星数(类似于点赞)已经超过了20万。

发起人简洁明了地说明了什么是“996.ICU”,即工作996,生病ICU。同时还列出了相关的法律法规和相关事件报道。

其实,“996工作制”并不是一个新出现的概念。它其实早就存在,是指每天早上9点上班,晚上9点下班,每周工作6天。按照我国现在规定的标准工时,每周最高工时为48小时,“996工作制”的每周工作时间,明显要高于规定。但令人深思的是,实施“996工作制”的公司,大多是互联网行业的知名公司,包括华为、阿里巴巴和京东等等。

The Labour Law of the People's Republic of China states that labourers shall work for no more than eight hours a day and no more than 44 hours a week on average. Consequently, critics argue it is illegal to have the 996 working hour system.
一些中国公司将“996工作制”作为自己的官方工作时间表。根据我国《劳动法》规定,劳动者每天工作时间不得超过8小时,每周平均不能超过44小时。因此,反对人士认为,实行“996工作制”是违法的。

Although these incidents were investigated, the system is reportedly still in use since its use by 58.com was reported in September 2016. Some Chinese programmers also started an "Anti-996" protest on GitHub in March 2019.
尽管这些事件已被调查,但是据报道,自58同城于2016年9月表示使用此工作制以来,该工作制一直在使用。2019年3月,一些中国程序员开始在GitHub平台上发起反“996”项目。

The culture of overtime work has a long history in Chinese companies, especially in some technical companies.
加班文化在中国企业有着很长的历史,尤其是在一些技术公司中。

BBC says that it is the competition on low cost and speed that results in overtime work. Some internet companies pay the late-night taxi fares for the employees, in order to encourage overtime work, which is thought to be the influence of the employees from the external environment.
BBC表示,正是低成本和速度的竞争导致了加班。为了鼓励加班,一些互联网公司还会为员工支付深夜打车的费用,这被认为是对员工的外部环境影响。

Chapter 4 Article 36 The State shall practise a working hour system wherein labourers shall work for no more than eight hours a day and no more than 44 hours a week on the average.
《劳动法》第四章第三十六条规定,国家实行劳动者每日工作时间不超过8小时,平均每周工作时间不超过44小时的工作制度。

Article 41 The employer can prolong work hours due to needs of production or businesses after consultation with its trade union and labourers. The work hours to be prolonged, in general, shall be no longer than one hour a day, or no more than three hours a day if such prolonging is called for due to special reasons and under the condition that the physical health of labourers is guaranteed. The work time to be prolonged shall not exceed, however, 36 hours a month.
第四十一条 用人单位由于生产经营需要,经与工会和劳动者协商后可以延长工作时间,一般每日不得超过1小时;因特殊原因需要延长工作时间的,在保障劳动者身体健康的条件下延长工作时间每日不得超过3小时,但是每月不得超过36小时。

Article 44 The employer shall pay labourers more wage remunerations than those for normal work according to the following standards in any one of the following cases:
有下列情形之一的,用人单位应当按照下列标准支付高于劳动者正常工作时间工资的工资报酬:

(1) Wage payments to labourers no less than 150 per cent of their wages if the labourers are asked to work longer hours; (2) Wage payments to labourers no less than 200 per cent of their wages if no rest can be arranged afterwards for the labourers asked to work on days of rest; (3) Wage payments to labourers no less than 300 per cent of their wages if the labourers are asked to work on legal holidays.
(一)安排劳动者延长工作时间的,支付不低于工资的150%的工资报酬;(二)休息日安排劳动者工作又不能安排补休的,支付不低于工资的200%的工资报酬;(三)法定休假日安排劳动者工作的,支付不低于工资的300%的工资报酬。

Chapter 12 Article 90 If the employer prolongs work hours in violation of stipulations in this Law, labour administrative departments can give it a warning, order it to make corrections, and may impose a fine thereon.
第十二章第九十条 用人单位违反本法规定,延长劳动者工作时间的,由劳动行政部门给予警告,责令改正,并可以处以罚款。

到这里,我们已经很明显可以看出,“996工作制”是违反我国劳动法的一种工作制度。但是,网上曝出的实行“996工作制”的公司名单中,不乏许多知名互联网公司。

In September 2016, the company 58.com officially declared the 996 working hour system, and it was widespread on the internet, which caused disputes and condemnation. Then 58.com responded that the business was very active during September and October, leading to the 996 system being encouraged, but not compulsory. However, when media interviewed the employees from 58.com, it was found that 996 working hour system was very common, with employees very often working overtime without overtime salary.
2016年9月,58同城正式宣布实行“996工作制”,在互联网上广泛传播,引起了争议和批评。随后58同城回应称9月-10月的工作量比较大,所以鼓励采用“996工作制”,并非强制要求。但是媒体采访58同城的员工时发现“996工作制”非常普遍,员工加班是常态,并且没有加班费。

58同城的996计划公开之后,一封来自京东副总何刚的邮件截图也在网上传开,这张截图显示他正在推行“996工作制”。

There are at least 40 companies, including Huawei, Alibaba Group, JD.com, etc, which implement 996 or even more intensive work schedule.
至少有40家公司,包括华为、阿里巴巴和京东等,实行“996工作制”或更密集的工作制。

根据文化、风俗、经济和工作状况的不同,不同国家实行的工作制也不相同。但是世界上大多数国家都普遍实行“8小时工作制”,这是资本主义早期,工人们长期斗争的结果。但是企业高管们普遍认为,实行“996工作制”可以鞭策员工,对公司发展有好处。有赞公司在今年的年会上宣布实行“996工作制”,CEO白鸦就表示几年后回头看,这绝对是好事。

但是普特君想说,把员工当机器一样使用,长期下去真的对公司发展好吗?一旦遇到媒体询问,各大公司的公关部也会表示,这都是员工自愿加班,不存在强制要求。这种违法的工作制,俨然已经成为行业默许甚至倡导的规则,还被一些公司宣传是培养狼性文化。
